Toxic Chemical Exposure

Toxic Chemical Exposure

Exposure to chemical spills, or long-term contact with industrial, cleaning, agricultural or veterinary chemicals can have devastating impacts on your health and wellbeing. Chemical poisoning can occur when toxic chemicals are swallowed, inhaled or when they come in contact with the skin. Amoungst others, symptoms include nausea and vomiting, dizziness, breathlessness, abdominal pain, burns, irritation of the eyes, skin and mouth, or unconsciousness. Whether the effects are immediate, or appear after prolonged exposure, poisoning can result in chronic injury, disease, disability, pain and suffering.

Asbestos and Harmful Dust Exposure

Asbestos and Harmful Dust Exposure

Exposure to asbestos or other harmful dusts when sawing, sanding, drilling, crushing, grinding or handling can also have profoundly negative health consequences. Patients with asbestos-related diseases such as mesothelioma and asbestosis, or other dust-related diseases (e.g. Farmers’ Lung or Silicosis) require substantial medical treatment, care and support (and the financial and psychological costs can be overwhelming.

Consequently, victims of toxic chemical, asbestos and other dust exposure are entitled under Australian law to claim compensation.

That is why we warmly offer our services to you: to alleviate the stress of claiming compensation and to offer legal support so that together we can attain the outcome you deserve.

Chronic lung diseases can be caused by inhaling certain powders or dust. While most dust diseases are cause by asbestos, there are some other products that are harmful when inhaled. These include:

  • Silica
  • Hard metals such as tungsten and cobalt
  • Aluminium
  • Beryllium (chemical element used in the manufacture of mobile phones, missiles and aircrafts)
  • Bagasse (by-product of sugar cane after juice extraction)
  • Cotton and mouldy hay
  • Straw, molasses, and grain

Heavy and prolonged exposure to dust generated by these products can lead to associated diseases:

  • Silicosis and Silico-tuberculosis (exposure to silica dust)
  • Aluminosis (exposure to aluminium-bearing dust)
  • Bagassosis (exposure to mouldy molasses)
  • Berylliosis (exposure to beryllium)
  • Byssinosis (exposure to hemp, flax, and cotton particles)
  • Coal dust pneumoconiosis (exposure to coal dust, also known as Black Lung)
  • Farmers’ Lung (exposure to mouldy hay)
  • Hard Metal Pneumoconiosis (exposure to tungsten and cobalt dust)
  • Talcosis (exposure to talcum powder)

Dust-diseases lead to a number of symptoms, including coughing, difficulty breathing, chest pain, and mucus in the airways.

Work-related Asbestos Exposure

You do not need to be currently employed to seek compensation for an asbestos-related disease. In fact, you are entitled to submit a claim if:

  • You are no longer working for the business or organisation at which the exposure occurred
  • Your employer is no longer in business
  • You were a contractor or self-employed
  • You were employed by multiple businesses or organisations
  • You contracted an asbestos-related disease via contact with someone who was exposed to asbestos (e.g. asbestos fibres were on clothing that you handled).

In New South Wales, work-based claims are processed by the Workers’ compensation Dust Diseases Authority (DDA). Wyatts have extensive and specialised experience with Workers Compensation and will provide you with the legal support you need to achieve the claim you deserve.

Non-work-related Asbestos Exposure

You are entitled to make a compensation claim if:

  • Exposure occurred when you were not working
  • Exposure occurred during home renovations
  • You are not aware of when the exposure happened

In New South Wales, common Law claims are dealt with by the Dust Diseases Tribunal (DDT).

Other considerations

You are also entitled to claim compensation if:

  • Exposure occurred many years ago, or occurred interstate or overseas
  • Exposure was brief and limited
  • Exposure happened on multiple occasions
  • You currently smoke, or if you smoked at the time of the exposure.

Importantly, if you are a family member of someone that has passed away from an asbestos-related disease, you may be entitled to claim compensation on behalf of their estate or as a dependent.

If you are uncertain as to whether you qualify for compensation, please contact Wyatts Compensation Lawyers today for your free initial consultation.
